Now before you all freak out, take this in stride. Their primary purpose was to host full downloads of the episodes. These are something Hasbro releases usually a day later on their iTunes page. The letter did include a request to take everything down (Including the Pinkie Pie image :p), but the actual torrents and Multi-upload links may have been the main reasoning behind it.
As more information on the extent of this pops up, we will continue to report on it. For now though, it looks like iTunes is the best place to get the actual episode files without running into legal issues. They did actually fix the color fading for season two, so it really isn't a bad alternative, and a good way to support the show for those of you that aren't into the toys / don't have The Hub.
Note: People from Ponyarchive have stated that they will not be taking the site down.

A shame it happened, but not too surprising. The downloads are likely the only reason for it, and I doubt Hasbro will try to shut down the streams or youtube mirrors.

Awwww, that is very very unfortunate. Especially for those of us too poor to afford to buy them all individually. I guess it was only a matter of time though. And it's not like they are in the wrong to ask them to stop either of course. I can understand them wanting them to take it down. By offering free downloads of all the epsidoes, even in high resolutions, it's cutting into their profits a little. There's still Youtube to watch them on I suppose.

The torrents that were put up on Ponyarchive were generally the source video, meaning higher quality. If you're cool with inferior video quality with a bunch of artifacts, among other things, I suppose that would be a way to go though.

Seriously though, if the episodes are taken off of Youtube I'm going to be exceptionally angry. Some of us aren't capable of buying an i-Touch, much less WILLING, and plenty of people don't have access to i-Tunes. Hell, I only get three channels on my TV, one of them being the Espanol channel and another being Fox. No way for me to watch the show except Youtube.

Only by downloading the episodes to an external hard drive am I able to take them anywhere with me, and Itunes would keep them trapped within it's own program instead of creating a file. Unless you use 3rd party software to extract it I guess. And there's always keepvid, but I'm not sure the best quality will be available. This is a shame.

This is most likely due to the fact that the episodes they SELL (for an admittedly-expensive $4/ep) are being put up for free [watermark-free at that]. I doubt the YouTube videos are coming down. Plus torrents will fester on forever. On top of that, other sites will come in. The End of Ponies this ain't folks.
While I respect Hasbro and fully understand the cease and desist, it still sucks. Also, I would much rather buy DVD's than use Itunes.

While this may or may not be legit, the key thing here is to NOT freak out about this and start acting entitled and pissy about it. If PonyArchive truly shuts down, then that's a shame, but until there's actual, tangible consequences from this.

*sigh* It's only a matter of time before YouTube cracks down full force. I can see a lot of fans getting shut out all together if those online sources dry up and if iTunes doesn't offer the episodes in their location. Celestia help us if that IP bill goes through. I understand supporting a show like this by paying a few dollars per episode, but the bill is a whole nother can of worms i'd rather not open and express my distaste on the money/greed issues that are most likely fueling it.

Plus most shows don't get on iTunes Australia, so how the hell are we supposed to see shows without suffering through advertisements or paying out the ears on the 25% chance a show makes it to Australia?

This has nothing to do with SOPA. These episodes are not being used for review or fair-use purposes.
The episodes, are quite frankly, uploaded for full, free viewing and are essentially, for all intents and purposes, stolen and streamed for free. Which, by mere definition, is still strictly piracy, all things considered, and we are technically wrong for doing it.
The only response that we, as fans, really are entitled to have at this point is basically "Well, damn. They caught us. Guess free episodes are over."

ReplyDeleteTo those making a fuss about YouTube: YouTube and illegal downloads of episodes are totally different things. With illegal downloads, you can rip the episodes onto DVDs, share them with your friends, ect. In the eyes of a large company, it's like iTunes for free... there's no good that can come of it for the parent company. Most people who download the streams? Well, they're not going to buy the episodes from iTunes, you can assume.*
Many people, like me, watch the episodes on YouTube and buy the episodes on iTunes as well. Why? Because you can only watch the YouTube episodes with internet! And don't get me started with the millions of other reasons YouTune episodes =/= episode downloads...
That said, Hasbro COULD go after the YouTube versions. But why jump to that conclusion? It's a slippery slope argument that helps no one.
*I know some people can't use iTunes for some reason. That's okay, but Hasbro isn't going to tailor all their plans to suit those who are unable to use iTunes. And people who don't use iTunes because they dislike Apple: That's a choice! Suggesting that Hasbro cater to you because-you-hate-Apple instead of looking out for their own profit is both entitled and unfair.

When most of us DO have the money to support the things we like, we spend it. When we have to choose our bills and food for our family first, that's what we've got to do. But ignoring mental and emotional stimulation is likewise unhealthy. So we do what we do, and that's no one's business but ours.
In any case, blockheads aside... what does Hasbro think they're doing? This isn't going to drum up support or profits for them at all, just decrease them. The more people who their product gets spread to, the more people who have the money to spend on it will do so. It's so simple that I'm surprised their legal suit monkies didn't tell them that. By restricting access, the growth of the fanbase becomes limited, meaning word and interest doesn't reach as many paying customers as it was going to, decreasing potential sales.
It's not like a physical object, where if someone obtains it without pay, you lose out on what it cost to make it. With a digital 'item', it can be spawned a trillion times with no cost, meaning they lose exactly squat, just 'potential' sales that are highly subject in the use of that word.

I understand that they have the right to do that, but it would be annoying because I live in a country where there's no Hub, MLP episodes are not available on iTunes, and plus, our MLP dubbing is hellish late (episode 13 just aired). So, basically, I'm cut short of MLP.

ReplyDeleteEven if iTunes was not an option (which it still is, and should still be appreciated even if you don't like iTunes), and there was no other option to watch the episodes, as much as it does suck and you might be deprived the show, it's really Hasbro's judgement to make, because the show is owned by them.
The action doesn't "mean" anything, nor does it mean that DVD's are coming, or should be coming any more than they already are. It simply means that Hasbro doesn't want their own owned content streamed unofficially.
Just feel the need to bring up common sense, here as a counter-point to the irrational anger towards Hasbro that I know is coming. It's their show and their business.
We might not like it (and I will even say that I don't like this turn of events either, as I do not have The Hub and have limited access to MLP other than Youtube), but we really have to abide by the decicion.
Also, do NOT associate this with SOPA. SOPA is a completely different matter entirely. SOPA is about legislating harsh personal PENALTIES for offenses that do not necessarily constitute piracy and confusing fair-use with it.

I just felt I should write in with an update on what's going on. I've been
an admin on the site for a few months now, my tasks have primarily been
managing donations as well as managing some videos on the site. I've
decided to leave PonyArchive due to differences of opinion on how to react
to this; personally, I think keeping up a good relationship between Hasbro
and the fanbase is more important than keeping the site up, while the two
founders of the site have decided that they're gonna keep going despite the
takedown notice.
My own personal stance on this is that I can see where Hasbro is coming
from, with DVDs being released and the show up on iTunes. On one hand, I'm
pretty sure they're gaining more from PonyArchive than they're losing (Lord
knows I've bought more than one or two toys since coming onboard), but on
the other hand, it's their copyright and if they want the site down, then I
think that's their decision to make. This is why I've decided to leave the
site.

It is Hasbro's property and they are promoting downloading it for free (I can see the itunes rips as being what really annoyed them). It's not eternal night, it's not the end of ponies, just a hint to be a touch more discreet.

I only sent two emails to my senator, but I hope to God, Celestia, Luna, and whoever the new alicorn is (I forget who she right now) that it does not pass. I still do not have the Hub, and the only way I can see the new episodes is via download.

I'm a poor college student though, and although I can download them from youtube It was nice to have someone collect a bunch of links for use by all. I will be sad to see it go, if it does eventually. Unfortunately SOPA is up for a vote tonight. Let's hope that the House has enough sense in them not to pass it
ReplyDeleteThey were probably pushed into issuing a CnD on behalf of iTunes. Since they likely had a licensing agreement with iTunes, they would be obligated to take down this illegal competition to protect iTune's interests.
ReplyDeleteAs for watching it on the HUB, I'm not going to pay 80 bucks a month for the cheapest cable package that has the HUB just to watch MLP. I'm sorry but it's not happening, and there certainly isn't anything else good on (for the most part).
At the same time, I am not a fans of iTunes due to their DRM method, if I want to watch my episode on a device that isn't Apple or doesn't run iTunes? I'm out of luck.
I'd love a way to support the show more directly. I'd gladly buy the episodes directly from HUB.com or pay a monthly fee to subscribe to a streaming version of HUB.

ReplyDeleteNot everyone lives in America. For some people, we have no choice BUT to 'pirate' the episodes. When Hasbro takes them down, we basically have no more ponies. I understand perfectly that Hasbro has every right to take them down, but it's just extremely upsetting that many people won't be able to watch ponies anymore, and you guys just assume everyone has access to that iTunes stuff and label us as 'whiners'.

ReplyDeleteI would be super upset if this were happening to youtube. I don't have disposable income falling out of my hindquarters, but I still feel that we should be supportive of Hasbro protecting their pockets.
I'm not certain taking down episode downloads is "restricting access" to the show. The only way this hurts Hasbro is if enough people get upset about it or if less people have quality downloads to make PMVs from. If this was Hasbro going after youtube, I'd completely agree with all of your points. But saying that removing Ponyarchive's downloads (while still not touching youtube) hurts the show's popularity... I'm not certain it does.
That said, I do apologize for being so "RWAR" in my other comment. I commented right after reading some other comments in this thread, and it made me a little more abrasive than I should have been.
I had a feeling that Pony Archive would end up being shut down.

ReplyDeleteThat is an issue, isn't it? I'm moving to France soon, so this will likely affect me in some way- my suggestion is to hope for the best. I would personally stock up on all the previous episodes and try to stream any new episodes that happen to be released every Saturday at approximately 10:00 A:M EST.
I'm glad that Ponyarchive was only the hosting site. This won't stop people from seeding the torrents, which is good, because I just started torrenting season 2 to bring with me on vacation.

I don't see any issue with the HUB/Hasbro leaving it to stay. Although most people I know end up watching it on youtube anyways, rather than downloading it. Besides, if it weren't on Youtube, I probably wouldn't have even known much or anything about the show, and would have just let it go by unnoticed. If Hasbro would actually RELEASE a physical DVD/Blu-ray for each season, that would be AMAZING, and I'd definitely put my money fourth into getting it. In the meantime, I have 5 mlp figurines of my own, and bought my niece a nice brush-able Pinkie Pie toy. I also wear a couple pony shirts to help spread the word of ponies, love and tolerance. Taking down the show off the internet (for free and downloadable) isn't good marketing from what I can tell. I just hope they aren't dumb enough to take it off Youtube.
ReplyDeleteAlthough, with SOPA set to try and pass tomorrow, I REALLY hope it doesn't since it affects me for things I look into on the internet (nostalgia critic, mlpfim, pmvs, anime, etc.), and censoring any of that would be no good for any of us. I know the Ponyarchive issue has nothing to do with SOPA, but it's still a similar issue. I still think SOPA is too retarded to pass, but the US isn't known to be that smart when it comes to making decisions either. -.-
Forgive me if I was/am stating the obvious but this just sucks hopefully it wont get any worse than this at least and youtube will remain intact.

This will probably turn out like the Pirate Bay C&D incident(s): the legal team will issue lots of letters, the infringing site will laugh at them and change servers a couple of times, then nothing will happen.
I personally think that if it wasn't for sites like those that promote the adult fanbase, this show quite possibly couldn't have made it to the 15th episode.

Those bills will be the death of freedom the entire world over, and I don't mean freedom to be an internet pirate. I mean entire websites going down because of one person doing something the acts say they can't, and -everyone- suffering as a result.

Ditsy is not happy about this.... and yet she still Loves her Creators. I'm Perfectly fine if PonyArchive can use the file uploading and just get rid of the torrents. I've been real picky about my Pony Vids. I prefer the MKV's over the MP4's. The MKV's are just cleaner looking compared the jagged lines in anything round and the Youtube and Itunes versions. That's just me. Plus the MKV files are easier to re-encode even though it may take longer. MP4's just crash and error when trying to encode files.

ReplyDeleteWhile i concur with hasbro doing its dirty laundry, it's up to them how much they want to give the fandom a 'free share' of the show. For example, I'm a mexican Brony and I watch the show on youtube or livestreams, the show is now being transmitted here but we're not even on Sonic Rainboom.
I don't use apple, let alone iTunes. Even if I do, the only way to get money to spend in there is to go and buy a card for iTunes or spend money in a credit card that 1 in every 1000 persons can.
It's unfair because it would be forcing (in the worst of cases) me and everypony outside of the US to use iTunes and download the episodes from there. But it still, Hasbro's property

Sadly, this was bound to happen eventually. It doesn't make it any less painful though.
ReplyDeleteI just wish there was another legitimate way to get the episodes (like a proper DVD set *shakefist*) so that we weren't stuck with iTunes. Youtube is nice, but the quality does get affected by their encoding process, and they're not very portable that way.
The fact that ponyarchive refuses to cease and desist deeply saddens me.

While piracy is inevitable, I think because these guys have been approached by HASBRO THEMSELVES, it would probably be safer just to leave it to thepiratebay or something. We're lucky that hasbro has been so lax with us so far. I think these guys shouldnt push their luck or they may ruin it for everyone.
While watching the Hub or downloading off iTunes may be fine for AMERICANS, I live in Australia and therefore cannot view it on the Hub (neither the Hub, nor pony airs here). On top of that, iTunes doesn't allow Australians to download the episodes because they are region locked. If You tube gets taken down that's the end of pony for me.

First thing I did with my graduation money was to buy the entire first season on iTunes (a damn fine decision). I probably will never buy a toy (I tried once, but the girls toys aisle scared me. -.- ) but I will always buy the shows to show my support.

Well this sucks. But at the same time, it was to be expected. Ponyarchive should obey the cease and desist order. I don't want their refusal to do so to make things even worse.
ReplyDeleteThe best situation (legally speaking) would be for ponyarchive to use this opportunity to see if they can work out some agreement with Hasbro. Probably by not offering the episodes DRM-free at full quality.

Still, while I perfectly understand the decision is up to them in my logic mind, my ethical mind tells me it's punishing their fans and supporters, which is never a good return for admiration. Also likely to hurt future business, as I work under the assumption that PonyArchive won't be the last.
Frankly, I'd be willing to bet only ten percent of the fanbase (a very generous figure, given my observations) actually found ponies through the 'legal' channels, and without those of us who hadn't, more than half of -that- number would still be doing whatever they were doing before they became bronies, and Hasbro would not be benefiting from their hard-earned cash.
Wel I'm not getting the episodes off of iTunes. As much I would love to support the creators and all that, I refuse to use anything branded by Apple, even if the fate of the universe depended on it.

ReplyDeletePersonally I think that to some extent this is Apple's lawyers being Apple. They charge rediculus prices for content that they then make as hard to use as possible. Also? A lot of that 2.99 per episode goes to apple. If hasburo put up the show themselves I bet 1. it would be cheaper, and 2. it would be drm free (or at least have less of it.) Finally I honestly don't have ~$70 to blow on a show that (while awesome) just can't really compare to steam games on sale for pure amount of time it will keep me entertained. Finally (really) This whole brony thing (started and still is) primarily a YouTube/online thing. I doubt that a large portion of us (maybe 5-7% tops) go on to buy the show on itunes. I think that (honestly) most fans are not enthusiastic enough to spend money if there is a pay barier set up.

Ultimately this isn't a huge deal for anyone. If, however, Hasbro goes after the episodes on youtube, they're only shooting themselves in the foot. This is a merchandise driven show, not one that makes much money off the show itself.

iTunes has been nothing but trouble.
PonyArchive has been the best source for High Quality episodes outside of watching them when they air.
I can understand this. I expect Hasbro will not do anything about the Youtube episodes, though. If they do, it would be like shooting themselves in the foot.
ReplyDeleteFrom Hasbro's point of view, the MLP shows themselves have always been extra long ads for their toys. MLPs internet popularity is a massive, and free, ad. I could understand removing pirate episodes while they have iTunes episodes for sale. However, removing their episodes from Youtube would be like taking down the ad before even finding a way to profit from it's attention.
With that in mind, Hasbro has done almost nothing to profit from all the Brony attention it has been getting. There are far more lucrative avenues for them to explore before they ought to consider C&D methods. Consider the internet, aiming this at Youtube would benefit Hasbro very little in the short term, and probably hurt them more in the long term. (It's not like you can stop pirating on the internet, and Bronies are a pretty tech-savvy user base.)
all i can say is they signed a death warrant by refusing to take it down. Hasbro can use their legal department to force the site down and if they wanted to (which they should if they wont take it down) find and criminalize those who owned the site.

I've heard that it's just parasprites reporting videos and not Hasbro...do you know if it was Hasbro themselves who keep hitting you with takedowns? Because that would make me quite sad, indeed.
