Trolls have taken down Alex S' Youtube account after several takedown notices by obviously fake names.
Here's to hoping he can get that resolved- in the meantime, his new channel is here.

2) this kind of thing has happened before to other channels. Dark times ahead or not, we've pulled through this shit before. Youtube's been doing this for months now, thanks to the trolls.

ReplyDeleteYeah, I guess my sarcasm didn't quite show through. I'm sure you're right, but sadly YouTube has no incentive to change, as long as they're still the go-to video uploading site. I suspect Google could easily hire people to check on copyright violation claims if they wanted to, or even develop software to filter out the most obvious trolling attempts, but from their perspective the current system works: media companies are happy it's easy to get videos taken down, and the people who're taken down keep coming back to YouTube because that's the place to be.

ReplyDeleteThis happened to OC Remix a little bit back. If enough people tell youtube to restore his account because he did not violate any 3rd party copyright laws, they probably would do it. The only reason they wouldn't be able to restore his account is that he accepted donations, and even if he did, as long as it is not directly something from copyrighted material he will most likely be fine. So... hop to it bronies.

YouTube has gotten too big for its own employees to handle, and they're stuck in a constantly losing battle between catering towards major copyright holders and fending off the trolls...wait no, Wendigos. I love that term, and I'm going to use it.
ReplyDeleteThey can take away the Wendigos' means of abusing DMCA and limit the effectiveness of the report function. However, that would leave the door open for legal hassles from copyright holders, especially if it creates a gargantuan backlog of reports that they're too slow to handle.
On the flipside, they have the current system. It keeps them free from legal trouble, but now the door is wide open for the Wendigos to swoop in and ruin everyone's fun.
You cannot go half-way between either option, you cannot compromise on that. Either go fully one direction, or fully the other. Otherwise, they won't be doing enough on either end, allowing the problems of both options to manifest. Since YouTube would do well remaining a legal business venture (understatement of the year), they choose the route that protects the IP of copyright holders at an expense that gives a disproportionate quantity of power to the Wendigos.
YouTube has just gotten too big.
I'll make a point to update my bookmarks listing for all my musicians. After seeing this, I just can't depend on YouTube to keep them up. Hopefully they all maintain a Bandcamp or Soundcloud.

They're reporting videos to troll and are trying to close peoples accounts to be trolls.
They already got my main account and I tried filing a counter claim against the false copy right but the staff are too stupid to see that it's just trolls being idiots.

The YouTube Staff should do something about these guys but I doubt anything will happen.

But here's the rub of the matter - by going after Warvan and NCF, you'll only make them want to troll us MORE. The more we retaliate, the more they'll know they're hurting us, and the more they'll do to hurt us.
Don't feed the trolls. Starve them out. Resist them silently with piles of peaceful messages to Youtube, and avoid discussing NCF in a derogatory manner.
They've cut themselves off at the knees anyway, publicly accepting blame for troll-flagging.

We were born from the fiery crotchpit that is 4chan, and we came out just fine from that. Remember when most bronies were located on 4chan, and the mass bannings swept back and forth for weeks? If we survived that as an infantile fandom, then we can survive anything.

ReplyDeleteIt is not a hate crime. However, it might be illegal. Filing a false Cease and Desist is perjury. Falsely flagging a video might not be, I don't know if you have to swear under penalty of perjury or not. It would be stupid for YouTube to not require it, as they are not legally obliged under the DMCA to do anything otherwise.

ReplyDeleteWhen google took over youtube it went down hill from there. Google started to fill youtube up with adds and if you get partner you get paied to let them put adds up on your channle. New look changes that annoy us all and now this. This has been happening too many times because google let a computer do the work not real people. This is where I see the problem. The computer is not smart enough to know that these are fake names so it will only do what it is programed to do which is as I assume to take down a channle if there are too many bad reports on it. I however could be wrong with this I am only going off what I currently know

ReplyDeleteIf the trolls actually go through the legal process, YouTube basically has to take the videos down. They can put them back up if it turns out to be false, but until then they do because they would be held liable if it weren't.
Alex S., my support goes out to you. Even though you still have your songs intact, to have to re-upload them is a painful hassle, and I hope sincerely that Youtube gives them back.
ReplyDeleteThinking of the recent bans that has popped up because of some trolls and the system that Google has imposed, I think it is better for a new website that hosts only pony videos.Safe from automated bans, no copyright holder would mind (maybe except Hasbro), and future trolls will be detected and denied of their fun. The only problem here is that someone needs to code the website, get a moderator staff, and make a new video something ( You know that thing don't you? The one that Youtube and other video hosting sites use. The one that enables us to watch videos. Sorry but I'm only 13 and I don't know the world for that...)
ReplyDeleteLegal or not what these trolls are doing is wrong by any standard. Their hearts are cold and minds are torn. I dont know what could possibly drive someone to attack a group of people that represent Harmony, Love, and Tolerance. Maybe it is simply ignorance. But because of some comments our fellow bronies have made over there, I am sad. Someponies have said very nasty things that are offensive to a lot of ponies even we, the Bronies. Those words are Hateful. When we say such foolish things, the trolls win.

ReplyDeleteThat's a disturbing thought... I doubt it, but i also don't put anything past those sick foals at PA. If they DO prompt legal action by hasbro against them over ponyarchive.eu, then it'll force Hasbro to basically lawyer up, and to prove to the court that they should judge in their favor, they will have no choice tut to actively protect the IP in question, and that WILL lead to Hasbro actively attacking pony content on YouTube.
PA needs to disappear quietly, or be taken down by an army of bronies at this point.
NOTHING good can come of Hasbro being driven to action to take down PA.

But to be honest, there are other reasons for people hating this cartoon before actually watchin a single episode, I'm a mexican brony, and most people here are too "macho" to watch an apparently girly cartoon, which is stupid if you ask me, I mean, If somepony fears that his manhood or "macho" status will be destroyed just for watching a "girly" cartoon, then they are insecure about thier own manhood.
People tends to judge things without actually knowing it, so yes, you are right about your ignorance argument. But some people just take that to the extreme such as these NCF trolls.

People have actually made a pretty big mistake here in my opinion. Never give someone credit for something like this. All it will do is fuel his ego, make him think he's some "UB3R L33T TROLLZ LULZ" and keep him going. Would have been better to let him fade into obscurity, just pin the takedown up to "a troll".

Youtube is legally obligated under the Digital Millennium Copyright Act (DMCA), to take down any video when an infringement of copyright is alleged. Youtube can not legally review or evaluate any such allegations, lest they loose their "safe harbor" status.
Safe harbor means that Youtube is not considered liable for the content third parties upload to their website, because Youtube claims to be a mere passive platform for users to upload to. If they started arbiting the content, they would no longer be passive, and would loose the safe harbor status.
The process under DMCA is roughly like this:
1. Someone files a takedown notice with Youtube.
2. Youtube is obligated to take the video down.
3. The person who uploaded the video can now file a counter-claim to Youtube.
4. Youtube passes the counter claim, along with contact information to the party who claimed copyright.
5. The alleged copyright holder can then use that information to sue the uploader for copyright infringement.
6. If the alleged copyright holder does not sue (because the copyright claim was bogus), the taken-down video is restored.
So, even if the copyright claim is competely laughable and obviously fake, Youtube must take the video down, or loose their legal protection wholesale.
What these trolls are doing, is abusing the DMCA-system. They are filing false copyright claims, to force Youtube to take down certain videos.
So, if you want to rage, rage at who deserve it: The trolls, and the american politicians, who instituted sweeping laws like DMCA, which give huge freedoms and vast abilites to companies.
And while you are raging at DMCA, ever heard of SOPA? SOPA makes DMCA look tame! So go rage at your congressmen and senators, as well.

guys seriously this isnt even a big deal this happens all the time for various reasons yea this time its by some douche but think about it, this person has at most 20 followers (lurking him for a lttle while) while we have a fanbase of im obliged to say hundreds of thousands of members, plus Alex S could probably get the account up in a week and even if he doesnt trolls cant take away his musical talent as well as all the other creative geniuses in our fandom, just in our recent activity we raised 6,500 dollars for charity while trolls just took down one tiny youtube account (no offense to Alex) we can change the world and compared to us they are nothing! So keep strong this is at most a minor setback for Alex and even smaller setback for us bronies!
ReplyDeleteThe trolls were able to use his own name to file a claim, because he filed a counter claim. You have to give your full name and contact info when you file a counter claim. Needless to say they could do more than troll with that info, which is why some people don't file them. And I have yet to hear of someone getting jailed for filing one of these false complaints.

Youtube will never fix this problem. They don't have to and they're too busy pissing people off with stupid redesigns of the site. Saying something in the help forums won't do anything because Google doesn't pay attention and all you get are "top posters" refering you to youtube's copyright info or pretty much telling you "deal with it".
Might be time to go to a place like Blip TV which doesn't have that problem.
Oh and I just read SOPA won't be worked on again until congress comes back in January.

If the actions of a single corporate entity and a few trolls can bring us to our knees, well, I honestly don't know what to say, except maybe we need to re-watch the episode from this week.
