PMV: Friendship is Magic RaNd0Mn3S5 #5

RANDOM time, it's almost a Youtube Poop, but not really.  Or something.

And if that isn't your thing, have some Fluttersphere. I have no clue how to categorize that either!

Check them out after the break!

UPDATE: Apparently fox is cracking down on pony stuff too, the first one was sent to the moon.

Seriously guys, all his videos are gone :(

Floof Cat said...

It said the channel was deleted, not just the video. They've parodied quite a number of things, and some companies make complaints. Then again, some pony haters put in complaints pretending to BE the company, so it could be another hater attack...

Renfield said...

It's not Fox.

Check the last name: "Roxy Newell" Oh wow. A dead person for 100 years claims copyright infringement. I guess we know *who* is responsible in reality.

I hope the whole lot of them get searing-hot pokers up where the sun doesn't shine.

FOX... WHY FLUTTERSHYELSA!?

Brett Turner said...

you know, i believe in love and tolerance and all that, but sometimes we need to take action, i don't mean flamewar/complaining to everyone, these trolls are taking down all of our videos! plus, i would like to see someone like jayson actually tell us what is going on with hasbro, why they are taking all our sites and videos down.

Mattatatta said...

Why can't YouTube ban IP addresses from making copyright claims if the IP addresses keep abusing the powers?

Any idiot can use the user-friendly (ironic) interface YouTube has for submitting copyright complaints, but it takes someone with a bit more technical know-how and a lot more patience to circumvent an IP ban AND submit fake reports.

There needs to be more counter-measures against abuse. Banning troll accounts is pointless since troll accounts have no videos, no views, and no value to the user. Whereas the accounts banned due to trolls have all three of those things, and all three of those things take a VERY LONG TIME to accrue. I say ban the IP addresses from submitting claims, continuous abuse from a specific range should be range banned from using the copy claim service. The IP bans need not ban the IP from all of YouTube, but instead prevent the IP from submitting copyright claims. To counter any uproar, the bans could be appealed against and they can also expire if it's a first time offence.

This is coming from a guy who is using common sense and posting his thoughts for free. They pay fuckers lots of cash at Google HQ to fail at what I'm doing.

psmylie said...

Seriously, can we just make our own youtube-style thing? This is getting seriously annoying...

Masterge77 said...

It's obvious the NCF was behind the removal of the first video, because of them, pony videos aren't safe.

We can still love and tolerate while kicking these trolls asses! I'm sick of this shit.

@Brett Turner Is Hasbro really "taking all our sites and videos down" though, or just one site that provided free downloads of HD episodes?

The system Youtube is working with is just ridiculous.

It's time the fandom emancipates itself from youtube. If it can easily be manipulated by those wastes of carbon and oxygen, it's best to move it elsewhere.

OtterMatt said...

We're just this week's flavor of Haterade, guys, chill the buck out. The depravity of trolls is only matched by the brevity of their attention spans.

SonicRatchet said...

@psmylie I agree. It worked for Ponychan, I really don't see why there isn't a Hooftube or something out there.

@Masterge77 I'm not from the US, could please elaborate on what the NCF is? The only thing I know it stands for is Nederlandsche Cocaïnefabriek(Dutch Cocaine Factory) and I'm pretty sure they weren't the one who took the video down.

this is getting out of hand, first Alex S. and now Fluttershy Elsa? someone needs to wright a long letter to Google (Who happens to own YouTube by the way) and explain to them whats going on and why thier automated take-down is doing more harm than good.

Bombedrumbum said...

@UltimaShadow7 but then the whole site is liable to be taken down, SOPA or not

Amonisis said...

@Bombedrumbum

i say it should happen, cause theoretically under your statement, then EqD would also be taken down, however it is still here alive and kicking.

we either need to get youtube to stop their idiotic auto-removal of pony vids, or create a new site. if we don't do either, then we are basically submitting to the trolls and they will win.

Masterge77 said...

@ponyofthelowlands The NCF (Niggest Chaos Force) is a group of trolls on Youtube that are going around reporting false copyright claims with names such as "Adolf Bush", "Roxy Newell", and even "Gabe Newell" (yes, the same one that runs Valve), they are a very dangerous group.

TerraH said...

That doesn't make any sense! What does Fox have to do with Ponies?!

Skrist said...

@Masterge77
If that is true that they are using Gabe Newell's name... oh boy, someone tells him and youtube is in for a world of hurt due to identity theft.

SuperGiantRobot said...

@TerraH
Nothing. If you see two or more copyright claims from the same source, it's ALWAY trolling. In fact, multiple copyright claims at ALL are generally false claims.

marioandsonic said...

That copyright take down has to be a troll. What does Fox have to do with ponies?

And "Roxy Newell"? Really?

Toksyuryel said...

Here's what you do whenever your videos get hit with false claims: http://www.youtube.com/watch?v=ny3pMGFnwMQ

I wish that more people on youtube would watch this video and dispute these false claims instead of just lying down and taking it.

Bear said...

Fluttersphere was beautiful, very well done.

How in the name of Celestia could Fox have any control over #1? I thought they had no hold in the pony franchise.

SgtGarand said...

So much pony being removed lately. It's like they waited for the holidays to strike at the worse possible time. Damn trolls and stupid YouTube for allowing the abuse of the flag button. I think only legal teams for said groups should be able to make those claims. And not through some generic button, but by contacting YouTube's owners directly.

#2 Is pretty good, but then again...it's Fluttershy, so there was very little doubt to begin with

SuperGiantRobot said...

Again, guys, it wasn't Fox. No company would ever copyright claim something more than once; they' wouldn't need to. I don't think you're even allowed to.

ScootaChicken said...

How can Youtube allow people to abuse the flag button? If a group of trolls assembles, they could probably remove whatever video they want.

Maquabra said...

The only way to guarantee the wellbeing of fandom is a coordinated action which would try to make a compromise with Hasbor about their copyrights.

Artists need to work in peace, uploaders of various content need not to fear of being sued and people, who want to watch episodes need to do it without breaking any laws. It could be done but nobody cares. PonyArchive was abandoned instantly. Some of us were sending emails to Hasbro and MLP-related people about condition of fandom but we are not organized in any way. We have no brand like Equestria Daily which could be our representative.

I believe that we could make an agreement with Hasbro which would make everyone happy. They get unbelievable aid from us with promoting the show. It's even more unbelievable that they are not milking it much more. For example, there is no merchandise specially for bronies and "shrek-styled" merchandise which would hold references to our memes etc. while still being normal toys for children. Producers of the show are somewhat with us but they are contract workers of Hasbro after all.

I was going to buy shitloads of pony stuff as gifts for Christmas though there is almost nothing from G4 around here available, but it seems like Hasbro doesn't give a slightest funk about people like me not even allowing me to legally buy their show (making phony itunes accounts is not a legal way to buy it) or downloading it in a civilized manner. Looks like I'm buying barbies and other bullshit like that this year.

What's the situation now? We will get whatever we want anyway because things like torrents exist. Damn, we don't even need their merchandise as we make our own. Even sites like Equestria Daily can move to countries like Ukraine. Try to sue us there. I'd wish them luck anywhere outside Northern America. We even have our professional Season 1 DVD box while they are still working on it!
With some kind of a deal, youtube content maybe could be protected too as it happens with other stuff that can be used for non-commercial use.

It's a ll possible but this fandom seems to be just a fandom, not a community. When PonyArchive was destroyed, the only real reaction was posting of a mocking picture. I bet that hearts of people behind PA grew thanks to all the support they got from people benefiting from their work...

Someone recognized in the fandom just needs to try to initiate dialogue with Hasbro. It's that simple.

Psyke Phaeton said...

@ScootaChicken thats pretty much what NCF (Niggest Crook Force) is, they were responsible for the take down of DJAlexs's youtube account as well as Celtic Brony, they use the name Gabe Newell. and they even told Celtic Brony they were going to keep flagging his videos using that name. you can find all that

Mattatatta said...

@Maquabra

Agreement between fandom or otherwise, trolls will still attack YouTube videos. Only if there was an agreement, Hasbro would be swamped with thousands of calls from the fandom's reps regarding takedowns and all of that bullshit. It'll stress Hasbro out, which'll end with the trolls winning because relations between Hasbro and the fandom would deteriorate.

The REAL ISSUE HERE is YouTube refuses to deal with what can be called cyber-terrorism. We should be angry at YouTube and their owners, Google, for failing to protect the rights of it's users and for failing to ensure that false claims were not as easy to submit as they are. Victims of fake takedown notices have NO DEFENSE against attacks, even if a channel or video gets reinstated, the damage has been done to the user's views, and their subscribers would have panicked.

cursormortis said...

@Maquabra
I can't see there ever being an agreement between the community and Hasbro. I'm fairly certain the main reason Hasbro didn't bother taking anything down as long as they did was because the stuff online wasn't really competing with anything they had out. Now there's DVDs coming out, and the iTunes thing probly makes them money as well, so they're getting rid of the (illegal) competition.

As for being a community, I think we'd have rallied around Ponyarchive a bit more if they hadn't literally told Hasbro to fuck off. I'm not happy that Ponyarchive went away, but I wish they would've done so with some tact rather than biting the hand that feeds us and could bring the hammer on everything if we piss them off.

Moving on, this "we'll get what we want no matter what" attitude is a really bad idea. It's more likely to piss Hasbro off than encourage them to work with us, and will only make things worse. Look at the game industry. Pirates laugh in companies' faces, and the companies respond by putting out even harsher anti-piracy measures. Do you really want something similar to happen here?

Finally, I really do wish Google and YouTube would find a better way to deal with copyright issues, but I don't know what that way would be. It's not like they have the manpower to review every video that comes in, after all, or probly even every video that gets flagged.

YabusameLuna said...

@Phantom240
Yer joking, right? It's been tried in the past, with no luck.

If you wanted to take down the people who did this, while they probably admittedly lurk /b/ and post cp and gore like worthless cretins. Punishing all of 4chan isn't the way and certainly would counterproductive, and that's putting it mildly.

If you wanted to take specific action against such people, you'd probably be better to have some kind of expertise and just destroy their computer and various accounts on the internet.

Given what they're doing here, they're probably doing something more illegal elsewhere. If someone had the expertise, it would be better to expose them.

Caerdwyn said...

@Fire Flash

No such thing as "freedom of expression" in a private context such as YouTube. Never has been. The First Amendment in the US (which is all that matters here, YouTube is under American law) regulates only what the government can do. Since YouTube is not the government, and is a private entity with terms of service that say it can disallow anything it feels like, that's the way it is.

What YouTube CANNOT do is lie about a user or deliberately violate its own terms of service. Their ToS, in keeping with governing law (the DMCA) states that only the holder of the copyright may file a claim. Nobody except Hasbro Studios or the fan artists in a fan-based video has legal standing to take down a pony video based upon the visual content. Nobody but the record label, musician or the RIAA (which has been given power of attorney to do so by the labels) has legal standing to take down a video based upon the audio. If YouTube posts a message claiming you have violated copyright OR that the takedown was in compliance with their ToS (which is a contract), and you haven't/they haven't done due diligence/are recklessly believing everything they hear in a takedown claim without verification, they are engaging in libel.

Obviously, Google is not complying with this, and one of these days it's going to get them in trouble. Google is simply banking upon the conjecture that hiring people to review copyright claims before the videos are taken down is more expensive than the eventual fines and libel settlements, that nobody will take it to court, and that the judge will not place negative value on having your good name slandered. They certainly are not in compliance with either the DMCA or their own ToS, and that's a fact.

"Do no evil", my ass.

As for the trolls doing false claims, identifying them through the discovery process in court, then going to their house and beating them til they can't walk without a cane is the way to go. Trolls respond only to their own physical pain, so it's time they had some.

Vinyl Scratch said...

Well, incase there was confusion about who is taking down these vids here you go.

They are being taken down by the "NCF" or "Niggest Crook Force" (not the Nationcal Christian Foundation. Although that made me laugh) They are a bunch of anti-brony Youtube trolls and the same people who brought down DJ Alex.S' channel.

So just make sure you guys grab your favorite pony songs on Youtube before they get taken down too.

Mojo said...

Goddamn it Youtube.

Robo-Dale said...

Lol it looks like a wannabe anonymous group attempting to put a small dent in the fandom which even at that they are failing incredibly. Oh internet, I can never get tired of you. XD

Shinmizu said...

If I remember correctly, aren't there fines involved in false DMCA takedown actions? I'm sure these trolling idiots don't have corporate-level lawyers on call to protect themselves from that, and true anonymity on the internet is a myth.

TheAntiCat said...

Oh fuck off Fox News corporation. Only you and that ego-obsessed prick Seth McFarlane shoot down this stuff left and right.

Robo-Dale said...

Keep calm and pony on I say. like i said previously, these little trolling groups come and go more than clothing or music trends I give em about a 4 week span tops before they get bored or Youtube wakes up and bans one member and then the whole group goes downhill in quality and crumbles. As much as I hate to say it, I used to be a troll in my younger years and was quite the annoying little brat but I knew how these little cliques of youtube went was in a few and they dropped the original agenda nearly 2 weeks after creation or stopped conversing between one another and eventually the group faded. No threat here just some kids without adult supervision and too much time on the school library computers. XD

Pave said...

Partially off topical thing to suggest, but since Youtube is getting more and more unstable place to upload videos, I have couple of alternatives. (Oh by the way in case someone wonders, no I don't even get a chance to negotiate to get bigger upload time-limit on Youtube, because I've been tagged/flagged for few coperighted materials.)

Fair thing to note well before hand, that these solutions are is you already own a blogging-spot or website. I personally have started to upload less and less on youtube mainly because there are far too many restrictions for my future content (especiallly since I'm going to do a lot of archiving).

Just to note that the main pro of all these websites are that there's no time-limit and you can upload more content with commentries and such. And in case of video is about being taken down, most of the time the dev/web-admin will contact you first, at least this is something I heard of from other users feedback (unless of course the content was totally offensive/broke all the rules).

Anyway, here's the list of alternative video hosting places as of late 2011:
-------------
Vimeo
+ (okay, there's not much of difference to Youtube, except you can upload up to 5GB sized files without time limit)
- Limited features for free users, especially if you're going to upload HD-material very often
-------------
Blip TV
+ possibility to gain ad-revenue (but their system has been really buggy, see more cons below)
- Very limited upload formats
- Max file size 1 GB even with Pro-account
- HD-option only avaible for Pro-accounts
- Occasional video cut-offs
-------------
PlayWire (I've nicknamed this service as Revver 2.0)
+ Three kinds of plans: Free, Premium & "Pay as you go"
+ At the moment, Premium user-account is still possible to get without any extra cost (you'll need to sent a separate appplication though)
+ Upload limit for premium-users 1.5 GB
(- Requires own website/blog to embed videos to (Not 100 % necessary, since they have "Sandbox"-section, where everyone can watch videos of other users, but as far I know, there's no Channel system like with other services))
+ "Sandbox". This is the reason why I have nicknamed this service as "Revver 2.0": If you share your videos here, any other Playwire users can also publish your video on their site, and you both share some of the revenue.
+ Real time customer service chat (during their opening times, of course. They're quite busy, but I've talked with them several times now)
+ Ads are served via Google Adsense, so most of the times the target audience gets correct ads
- Full free users only have 100 MB upload limit
- Advertivesements aren't served for free-users and as a Premium user, you can't turn of ads (which is understandable, because you aren't paying for file-storage).
- It's still rather new service, not many people don't know about this service yet (-> not much of written about -> possible low ratings WOT (Web of Trust)-wise and otherwise)

I know it may sound I'm super praising Playwire here. But then again, at the moment it's one of the better services out there with good, simple services.

And those are the services I can recomment at the moment. Obviously I'd want to get Playwire most people give a chance, because they at least try to make their servive/platform more better and customer friendly.

I just sent this as feedback to google

"I think it is WAY too easy for trolls and other parties to imitate being a copyright holder in order to get content removed from youtube. Case in point, MLP videos. I'm quite certain that 20th century fox owns no part of the my little pony franchise or legal holdings over weird al's music, so copyright claims made by fox against one "MLP: Friendship is magic Pony Polka" should be considered null and void. The only parties who should have legal authority over the copyright violations of content are the actual holders of the copyright, not just trolls hatin on ponies."

MrSteve said...

@MrSteve

I just did some followup research on the claims.

Seeing as how Pony Polka was taken down by Fox I thought maybe Weird Al's record label is owned by Fox.

It isn't

Volcano is owned by Sony, and all other record labels he has published under aren't owned by Fox. And Hasbro is a publicly traded company, which is in no way owned by Fox.

Conclusion: Youtube needs to shape up their Copyright verification process, requiring actual human contact from company legal departments before DROPPING THE FLUTTERING BANHAMMER ON FAN MADE CONTENT!

Lonercs said...

LET'S BAN FUCKING FOX! It's clear that youtube do not look to make sure that the copy-right claims are legit so let us make our own bullshit claims against them. THEY WILL BURN IN YOUTUBE HELL!

I shouldn't comment on this for fear of staring an argument but I will.

The video take down is from anti brony trolls which I find really pathetic, why waste your time flagging videos just becuase you have a silly grudge against a fandom? (Perhaps they just want the E- infamy? I don't know)

While I understand the reason behind why youtube complies with these flags I really wish there were a better way, it's not optimal to say the least.

A buttload of channels have died this same way. Allow me to link a video I, along with about 5000 other Youtubers, mirrored on my own channel as a way to spread the video around, and hopefully get it noticed by the YouTube higher-ups.

Spread this video around, please, and if you want to, Mirror it like I did. If enough copies of it go around, someone at Google might actually watch it and bring it to someone's fucking attention that can DO something.

BTW, Never heard of NCF, anypony want to tell me what they are?

@Chaos Knux I ask because I don't think anyone on this list can file that claim legally.

@Chaos Knux

From what I gather they're an anti Brony troll group, they're submitting alse claims to alot of pony related videos and youtube has to take them down as a reponse.

You can file a counter claim and get them out back up but as far as I know it takes some time.

It's probably not the actual Fox that asked for the takedown.

@Celestia: Thank you, your highness.
and I'm well aware it's likely not FOX. Their dumb as rocks, but they don't flag stuff that has NOTHING connected to them... yet.

Now if only there was a nice, alternative to YOUTUBE like NicoNicoDouga.

A place where the looks and features aren't changed on a daily basis by some dudes kid sister messing with his pc.

A place free from hater attacks that abuse a retarded '09 deal youtube made that opened up this bs of holding youtube responsible for whatever users post if they don't take it down.

If there was such a place how awesome would it be to just have everyone we know just migrate their stuff to a better world to express ones views and opinions without all the censorship.

What better way to fight back and show Youtube we won't stand for their auto-robot response to any and all false claims of copyright infringement. People want to record themselves singing a popular song or make a parody of something in fair use? Migrate it all to a new better alternative!

God I wish I had the know how and money to help build such a place =(

Here's another thread on the Youtube help forums that pretty much sums it up:

You can either file a counterclaim (though the form says use your full name, I don't see why you can't use your own fake one), or find another video site.
Also if a new pony video site was opened, you'd still have to deal with copyright claims, especially if it contains a song from a major record label or something. There is a way to protect a site from lawsuits, though it costs $105: http://www.wired.com/threatlevel/2010/10/dmca-righthaven-loophole/
By registering a DMCA agent you're given a little protection.

Wow debates. Aside from all that, I never really payed any attention to the second song. Now I've listened to it over 10 times...on the same night...I still haven't slept...

Please note (or update, if you're a mod) that FluttershyElsa's channel and videos are BACK IN ACTION.
